These Terms and Conditions govern your access to and use of the Council Toolkit, operated by Taituarā – Local Government New Zealand (“Taituarā”, “we”, “us”). By accessing the Council Toolkit you agree to be bound by these terms. If you do not agree, you must not use the Council Toolkit.
1. About the Council Toolkit
The Council Toolkit is a knowledge base providing guidance, process documentation, and resources to support New Zealand local government council staff in carrying out their regulatory and operational responsibilities.
2. Eligibility and Access
Access to the Council Toolkit is restricted to employees and authorised staff of New Zealand councils that hold a current active subscription with Taituarā. Access is granted through your council’s registered email domain. You must not share your login credentials or allow unauthorised persons to access the Council Toolkit using your account.
Taituarā reserves the right to suspend or revoke access at any time where a council’s subscription lapses, or where these terms are breached.
3. Acceptable Use
You may use the Council Toolkit solely for lawful purposes in connection with your role as a council employee. You must not:
- reproduce, distribute, or share Council Toolkit content outside your organisation without prior written permission from Taituarā
- use the Council Toolkit for any commercial purpose unrelated to your council role
- attempt to gain unauthorised access to any part of the Council Toolkit or its underlying systems
- use the Council Toolkit in any way that could damage, disable, or impair its operation
- scrape, copy, or systematically extract content from the Council Toolkit
4. Intellectual Property
All content in the Council Toolkit, including text, documents, process guides, and templates, is owned by or licensed to Taituarā and is protected by New Zealand copyright law. You are permitted to use, download, and print content for internal council purposes only. Nothing in these terms grants you any rights to reproduce or use Council Toolkit content for any other purpose.
5. Disclaimer — Not Legal Advice
The content provided in the Council Toolkit is intended as general guidance and information only. It does not constitute legal advice and should not be relied upon as such. While Taituarā takes care to ensure content is accurate and current, we make no warranty as to the completeness, accuracy, or fitness for purpose of any information provided.
Council staff should seek independent legal advice where appropriate, particularly in relation to specific decisions, enforcement actions, or complex regulatory matters.
6. Limitation of Liability
To the maximum extent permitted by law, Taituarā is not liable for any loss or damage arising from your reliance on Council Toolkit content, including any direct, indirect, or consequential loss. Your council remains responsible for decisions made by its staff.
7. Privacy
When you log in to the Council Toolkit, we collect your name, email address, and council organisation for the purposes of providing and administering access. We also record login activity to support reporting on usage across the local government sector. We handle your personal information in accordance with the New Zealand Privacy Act 2020. We do not sell or share your personal information with third parties except as required to operate the service.
8. Third Party Services
The Council Toolkit uses third party services including myTaituarā for authentication. Your use of those services is subject to their own terms and privacy policies.
9. Changes to These Terms
Taituarā may update these Terms and Conditions from time to time. Continued use of the Council Toolkit after changes are published constitutes acceptance of the updated terms. We will endeavour to notify users of material changes.
10. Governing Law
These terms are governed by the laws of New Zealand. Any disputes arising from your use of the Council Toolkit are subject to the exclusive jurisdiction of the New Zealand courts.
